Welcome to Q2M Platform ("Q2M," "we," "us," or "our"). By accessing or using our multi-channel quiz distribution platform at quiz2m.link and related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Q2M Platform. By creating an account or using our Service, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility and Account Registration

2.1 Age Requirements

You must be at least 18 years old to use Q2M. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian.

2.2 Account Creation

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized access or security breach
• One person or entity may not maintain multiple accounts without our permission

2.3 Marketing Communications

By creating an account, you agree to receive onboarding emails, product tips, tutorials, and occasional marketing communications from Q2M. These emails help you get the most out of our platform and stay informed about new features. You can unsubscribe from marketing emails at any time by:

• Clicking the "unsubscribe" link in any marketing email
• Adjusting your notification preferences in your account settings

Please note that even if you unsubscribe from marketing emails, you will still receive important transactional emails related to your account, such as quiz response notifications, security alerts, and billing information.

2.4 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason we deem appropriate. You may also delete your account at any time through your account settings.

3. Acceptable Use Policy

3.1 Permitted Uses

You may use Q2M to:

• Create and distribute quizzes for legitimate business, educational, or personal purposes
• Collect responses and analyze quiz data
• Integrate with messaging platforms (WhatsApp, Email, SMS, Telegram)
• Customize branding and quiz appearance
• Access analytics and reporting features

3.2 Prohibited Uses

You agree NOT to:

• Use the Service for any illegal, fraudulent, or unauthorized purpose
• Distribute spam, unsolicited messages, or engage in phishing
• Upload malware, viruses, or malicious code
• Harass, abuse, threaten, or discriminate against others
• Collect personal information without consent
• Violate any applicable laws, regulations, or third-party rights
• Attempt to gain unauthorized access to our systems or other users' accounts
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools (bots, scrapers) without our written permission
• Resell or redistribute the Service without authorization
• Create content that is defamatory, obscene, or infringes on intellectual property rights

Violation Consequences: Violation of this Acceptable Use Policy may result in immediate account suspension or termination, removal of content, and potential legal action.

4. Intellectual Property Rights

4.1 Q2M's Intellectual Property

All content, features, functionality, software, designs, graphics, logos, and trademarks on the Q2M Platform are the exclusive property of Q2M Platform or its licensors. This includes but is not limited to:

• The Q2M name, logo, and branding
• Platform software, code, and architecture
• User interface designs and layouts
• Documentation, tutorials, and help content

You may not copy, modify, distribute, sell, or create derivative works from any Q2M intellectual property without our express written permission.

4.2 Your Content Ownership

You retain full ownership of all content you create, upload, or distribute through Q2M, including:

• Quiz questions and answers
• Branding elements (logos, colors, images)
• Custom text and messaging content
• Response data collected from your quizzes

4.3 License Grant to Q2M

By uploading content to Q2M, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, process, adapt, publish, transmit, and display your content solely for the purposes of:

• Operating and providing the Service to you
• Distributing your quizzes via messaging channels
• Generating analytics and insights
• Improving and promoting the platform (with anonymization where appropriate)
• Complying with legal obligations

This license terminates when you delete your content from the platform, except for reasonable backup copies retained for up to 90 days and aggregated anonymized data used for analytics.

4.4 Content Responsibility

You are solely responsible for your content and represent that:

• You own or have the necessary rights to use and license the content
• Your content does not infringe on any third-party intellectual property rights
• Your content complies with all applicable laws and these Terms

5. Subscription Plans and Payment

5.1 Free and Paid Plans

Q2M offers both free and paid subscription plans. Features, limits, and pricing are described on our pricing page and may change with notice.

5.2 Billing and Payments

• Paid subscriptions are billed in advance on a monthly or annual basis
• Payments are processed through secure third-party payment processors
• You authorize us to charge your payment method for all fees incurred
• All fees are non-refundable except as required by law or stated in our refund policy

5.3 Automatic Renewal

Subscriptions automatically renew unless you cancel before the renewal date. You can cancel anytime through your account settings.

5.4 Price Changes

We may change subscription prices with at least 30 days' notice. Continued use after price changes constitutes acceptance of the new pricing.

6. Third-Party Services and Integrations

Q2M integrates with third-party messaging platforms (WhatsApp, Telegram, SMS providers, email services). Your use of these integrations is subject to:

• The terms and policies of those third-party services
• Additional fees charged by those services (e.g., SMS costs, WhatsApp Business API fees)
• Availability and functionality limitations of those services

We are not responsible for the performance, availability, or policies of third-party services. You are responsible for complying with their terms and any associated costs.

7. Data Privacy and Security

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. AI Assistant (Quiry) - Additional Terms

Q2M Platform includes an AI-powered assistant called "Quiry" that helps you create, optimize, and enhance your quizzes using artificial intelligence. Use of Quiry is subject to additional terms and conditions.

8.1 AI Feature Overview

Quiry provides AI-powered capabilities including:

• Automated quiz question generation
• Quiz content optimization and suggestions
• Intro slide creation and customization
• Question refinement and improvement
• Content analysis and recommendations

8.2 Mandatory Acceptance

Before using Quiry for the first time, you must explicitly accept our AI Terms of Use and AI Privacy Policy. This acceptance is separate from these general Terms of Use and is required to access AI features.

8.3 AI Content Responsibility

While Quiry strives to generate accurate and helpful content, AI-generated outputs may contain errors, inaccuracies, or inappropriate content. You are solely responsible for:

• Reviewing and verifying all AI-generated content before use
• Ensuring AI-generated content complies with applicable laws
• Editing or rejecting AI suggestions that are inappropriate or inaccurate
• Any consequences arising from the use of AI-generated content

8.4 Optional Feature

AI features are optional. You can choose not to use Quiry and still access all other Q2M Platform functionality. AI features can be disabled in your account settings at any time.

9. Disclaimers and Limitations of Liability

9.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

9.2 No Guarantees

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• Any errors or defects will be corrected
• Third-party integrations will function as expected

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Q2M PLATFORM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Q2M Platform, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your content or quiz distributions

11. Modifications to the Service and Terms

11.1 Service Changes

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation.

11.2 Terms Updates

We may update these Terms from time to time. We will notify you of material changes via email or platform notification. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Dispute Resolution and Governing Law
