Quiry AI Assistant - Terms of Use

1. Acceptance of Terms
By accessing or using Quiry, the AI-powered quiz assistant ("Quiry," "AI Assistant," or "Service") provided by Quiz to Message ("Q2M," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these AI Terms of Use ("Terms"). If you do not agree to these Terms, you may not use Quiry.
These Terms supplement and are incorporated into the Q2M Platform Terms of Service. In case of conflict, these AI-specific Terms shall prevail for matters related to Quiry.
2. Description of Service
2.1 What Quiry Does
Quiry is an AI-powered conversational assistant that helps you:
- Create quiz questions and content
- Strategize quiz structure and flow
- Edit and modify existing quiz questions
- Suggest question types and formats
- Generate intro slides and welcome screens
- Provide guidance on quiz best practices
2.2 What Quiry Does NOT Do
Quiry is specifically designed for quiz creation and does NOT:
- Provide general AI assistance unrelated to quizzes
- Write essays, code, or other non-quiz content
- Offer legal, medical, financial, or professional advice
- Store or remember conversations beyond the current session
- Access your personal information beyond quiz data
- Make decisions on your behalf
3. AI Technology and Limitations
3.1 Third-Party AI Models
Quiry uses third-party AI language models provided by OpenRouter, including but not limited to:
- Meta Llama 3.1 405B
- Meta Llama 3.3 70B
- DeepSeek V3
By using Quiry, you acknowledge that your prompts and quiz data may be processed by these third-party AI providers.
3.2 AI Limitations and Accuracy
You understand and agree that:
- AI-generated content may contain errors, inaccuracies, or inappropriate suggestions
- Quiry's responses are generated by machine learning models and may not always be accurate, complete, or appropriate
- You are solely responsible for reviewing, editing, and approving all AI-generated content before use
- We do not guarantee the accuracy, reliability, or suitability of AI-generated content
- AI responses may vary based on how you phrase your requests
- Quiry may occasionally misunderstand your intent or provide irrelevant responses
3.3 No Warranty
THE AI SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE MAKE NO WARRANTIES REGARDING:
- Accuracy or quality of AI-generated content
- Availability or uptime of the AI service
- Suitability for your specific business needs
- Freedom from errors or bugs
4. Acceptable Use Policy
4.1 Permitted Uses
You may use Quiry to:
- Create business quizzes for lead generation
- Generate customer feedback forms
- Build product inquiry quizzes
- Create service booking questionnaires
- Develop order forms and surveys
- Generate quiz content for legitimate business purposes
4.2 Prohibited Uses
You may NOT use Quiry to:
- Generate harmful, offensive, discriminatory, or illegal content
- Create quizzes that violate any laws or regulations
- Collect sensitive personal information (health data, financial data, etc.) without proper consent
- Impersonate others or misrepresent your identity
- Attempt to reverse engineer or extract the AI model
- Abuse, spam, or overload the AI service
- Generate content that infringes intellectual property rights
- Create misleading or deceptive quiz content
- Violate any third-party rights
- Circumvent usage limits or restrictions
4.3 Content Moderation
We reserve the right to:
- Monitor AI usage for compliance with these Terms
- Suspend or terminate access for violations
- Remove or refuse to generate inappropriate content
- Report illegal activity to authorities
5. Data and Privacy
5.1 Data Processing
When you use Quiry:
- Your prompts and quiz data are sent to third-party AI providers (OpenRouter)
- Conversations are temporarily stored in your browser's local storage
- We do not permanently store your AI conversations on our servers
- Your quiz data is subject to our main Privacy Policy
DO NOT share confidential, proprietary, or sensitive information with Quiry, including:
- Trade secrets or proprietary business information
- Personal identification numbers (SSN, passport, etc.)
- Financial account information
- Health or medical information
- Passwords or security credentials
- Information subject to legal privilege
5.3 Third-Party AI Provider Terms
Your use of Quiry is also subject to the terms and privacy policies of our third-party AI providers:
- OpenRouter Terms of Service
- Individual AI model provider terms (Meta, DeepSeek, etc.)
By using Quiry, you acknowledge and agree to these third-party terms.
6. Intellectual Property
6.1 AI-Generated Content Ownership
- You retain ownership of the prompts you provide to Quiry
- You own the final quiz content you create using Quiry
- AI-generated suggestions become your property once you accept and apply them
- You are responsible for ensuring your use of AI-generated content does not infringe third-party rights
6.2 Our Rights
We retain all rights to:
- The Quiry AI assistant software and interface
- Our proprietary prompts and AI training methods
- The Q2M platform and branding
- Any improvements or modifications we make to Quiry
6.3 License to Use AI Content
By using Quiry, you grant us a non-exclusive, worldwide, royalty-free license to:
- Process your prompts through AI models
- Use anonymized, aggregated data to improve Quiry
- Display your quiz content as part of the Q2M platform
7. User Responsibilities
7.1 Review and Verification
You are solely responsible for:
- Reviewing all AI-generated content before use
- Verifying accuracy and appropriateness of quiz questions
- Ensuring compliance with applicable laws and regulations
- Editing and customizing AI suggestions to fit your needs
- Testing quizzes before publishing to customers
7.2 Legal Compliance
You must ensure that:
- Your quizzes comply with data protection laws (GDPR, CCPA, etc.)
- You have proper consent to collect customer information
- Your quiz content does not violate any laws
- You comply with industry-specific regulations
- You respect intellectual property rights
7.3 Quality Control
You acknowledge that:
- AI-generated content requires human review and editing
- You should not blindly accept all AI suggestions
- Final quiz quality is your responsibility
- You should test quizzes with real users before full deployment
8. Limitations of Liability
8.1 No Liability for AI Content
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:
- Errors, inaccuracies, or omissions in AI-generated content
- Business losses resulting from use of AI suggestions
- Damage to reputation from inappropriate AI content
- Legal violations arising from AI-generated quizzes
- Third-party claims related to AI content
- Service interruptions or unavailability
8.2 Indemnification
You agree to indemnify and hold harmless Q2M, its affiliates, and AI providers from any claims, damages, or expenses arising from:
- Your use of AI-generated content
- Your violation of these Terms
- Your violation of any laws or third-party rights
- Your quiz content and its use
8.3 Limitation of Damages
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE Q2M SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
9. Service Availability and Changes
9.1 No Guarantee of Availability
We do not guarantee that:
- Quiry will be available at all times
- AI responses will be generated successfully
- The service will be error-free or uninterrupted
- Specific AI models will remain available
9.2 Right to Modify or Discontinue
We reserve the right to:
- Modify, suspend, or discontinue Quiry at any time
- Change AI models or providers without notice
- Update these Terms as needed
- Implement usage limits or restrictions
- Change pricing or access requirements
9.3 Updates and Improvements
We may update Quiry to:
- Improve AI response quality
- Add new features or capabilities
- Fix bugs or security issues
- Comply with legal requirements
10. Usage Limits and Fair Use
10.1 Rate Limits
We may impose limits on:
- Number of AI requests per day/month
- Length of prompts or conversations
- Complexity of quiz generation requests
- Concurrent AI sessions
10.2 Fair Use Policy
You agree to use Quiry reasonably and not to:
- Make excessive or abusive requests
- Attempt to circumvent usage limits
- Use automated tools to interact with Quiry
- Share your account access with others
10.3 Subscription Tiers
AI access may vary by subscription level:
- Free users: Limited AI requests
- Premium users: Enhanced AI access
- Enterprise users: Priority AI processing
11. Termination
11.1 Termination by You
You may stop using Quiry at any time by:
- Closing the AI assistant panel
- Canceling your Q2M subscription
- Deleting your account
11.2 Termination by Us
We may suspend or terminate your access to Quiry if:
- You violate these Terms
- You abuse or misuse the AI service
- Your account is suspended or terminated
- Required by law or third-party providers
- We discontinue the service
11.3 Effect of Termination
Upon termination:
- Your access to Quiry will cease immediately
- Locally stored conversations will remain in your browser
- Your quiz content will remain accessible per our main Terms
- These Terms will continue to apply to past use
12. Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of Nigeria, without regard to conflict of law principles.
12.2 Arbitration
Any disputes arising from these Terms or your use of Quiry shall be resolved through binding arbitration, except where prohibited by law.
12.3 Class Action Waiver
You agree to resolve disputes individually and waive any right to participate in class actions or representative proceedings.
13. Miscellaneous
13.1 Entire Agreement
These Terms, together with the Q2M Terms of Service and Privacy Policy, constitute the entire agreement regarding Quiry.
13.2 Severability
If any provision is found unenforceable, the remaining provisions remain in full effect.
13.3 No Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right.
13.4 Assignment
You may not assign these Terms. We may assign our rights and obligations without restriction.
13.5 Updates to Terms
We may update these Terms at any time. Continued use of Quiry after changes constitutes acceptance of the updated Terms.

BY CLICKING "I ACCEPT" OR USING QUIRY, YOU ACKNOWLEDGE THAT:
- You have read and understood these Terms
- You agree to be bound by these Terms
- You understand the limitations and risks of AI-generated content
- You will review and verify all AI-generated content before use
- You are responsible for your quiz content and its compliance with laws
- You will not share confidential information with Quiry
- You accept that AI responses may contain errors or inaccuracies
